HomeMeta's Fair Use Victory in AI Copyright Case Sets Legal Precedent
Meta secured a significant legal victory in an AI copyright lawsuit filed by 13 authors, who claimed the company trained its AI systems on their copyrighted works without consent. On Wednesday, Judge Vince Chhabria sided with Meta, stating the company is “entitled to summary judgment on its fair use defense regarding the use of plaintiffs’ books as training data for its large language model.”
However, the judge also highlighted certain weaknesses in Big Tech’s AI ecosystem and Meta’s fair use justifications. “This ruling does not mean that Meta’s use of copyrighted materials to train its language models is lawful,” Judge Chhabria clarified.
“It simply reflects that these plaintiffs presented the wrong legal arguments and failed to build a case supporting the correct ones.” This decision follows Anthropic’s separate fair use win from another federal judge, who determined that training models on legally acquired books constitutes fair use.

Judge Chhabria described two of the authors’ fair use claims as “clear losers:” Meta’s Llama AI occasionally reproducing short passages from their books, and the contention that unauthorized use for AI training harmed their ability to license their works. “Llama does not generate enough text from the plaintiffs’ books to be significant, and the authors have no exclusive right to the market for licensing works as AI training data,” the judge noted.
The plaintiffs, according to Judge Chhabria, did not sufficiently support a “potentially winning argument” that Meta’s copying could “create a product flooding the market with similar works, leading to market dilution.” He also referenced the Anthropic ruling, observing that Judge William Alsup dismissed concerns about generative AI’s potential to “harm the market for the works it is trained on.”
