xAI Secures Permits for 15 Gas Generators at Memphis Data Facility

Shelby County officials yesterday approved xAI's permit application to operate 15 natural gas-powered turbines at its Memphis-area data center, brushing aside legal threats from environmental advocates.
The Southern Environmental Law Center alleges Elon Musk's artificial intelligence startup has been running up to 35 unauthorized generators capable of generating 421 megawatts total. The organization plans to file a Clean Air Act lawsuit against xAI representing the NAACP.
The approval comes shortly after xAI secured $10 billion in combined debt and equity financing.
The newly issued permit authorizes operation of 15 Solar SMT-130 turbine generators equipped with emission control technology, collectively producing 247 megawatts. Environmental lawyers note eight identical units were already operating without permits, though they acknowledged these existing units do incorporate proper pollution controls.
Under the permit terms, xAI maintains authorization for substantial annual emissions including:
- 87 tons of smog-producing nitrogen oxides (NOx)
- 94 tons of carbon monoxide
- 85 tons of volatile organic compounds
- 73 tons of particulate matter
- 14 tons total hazardous air pollutants (including 9.8 tons of cancer-causing formaldehyde)
The company bears responsibility for maintaining comprehensive emissions documentation.
Prior to permit approval, Memphis activists announced securing $250,000 to commission independent air quality analysis.
The city conducted preliminary air monitoring last June, though SELC identified several methodological concerns:
- Ozone level monitoring was omitted
- Testing occurred during wind conditions favoring pollutant dispersal away from monitoring sites
- Equipment placement near buildings potentially compromised results accuracy
The health department initially claimed jurisdictional limitations regarding temporary generator operations (under 364 days), deferring regulatory authority to the EPA. SELC maintains this interpretation lacks legal basis, calling the department's justification letter "devoid of substantive legal analysis."
