HomeTrump Set to Criminalize Revenge Porn and Malicious Deepfakes
President Donald Trump is set to sign the Take It Down Act today, a bipartisan bill that establishes stronger penalties for sharing nonconsensual intimate imagery, such as deepfakes and revenge pornography.
The legislation makes publishing such images a criminal offense, whether they are real or AI-generated. Those who distribute the photos or videos may face criminal consequences, including fines, jail time, and victim restitution.
Under the new law, social media platforms and online services must take down such content within 48 hours of receiving a notice from the affected person. Platforms are also required to make reasonable efforts to remove duplicate posts.
Many states have already prohibited sexually explicit deepfakes and revenge porn, but this marks the first time federal authorities are intervening to enforce regulations on internet companies.
First Lady Melania Trump advocated for the bill, which was introduced by Senators Ted Cruz (R-Texas) and Amy Klobuchar (D-Minn.). Cruz stated he was motivated to take action after learning that Snapchat delayed for almost a year in removing an AI-generated deepfake depicting a 14-year-old girl.
Free speech advocates and digital rights organizations have voiced concerns, arguing the law is overly broad and could result in censorship of lawful content, including legal adult material and government criticism.
