South Korea Passes Law to Boost AI by Allowing Limited Personal Data Use After Regulatory Review

The Korean Personal Information Protection Committee recently announced that the National Assembly has unanimously approved an amendment to the Personal Information Protection Act, permitting AI developers to utilize limited personal data following committee review. This change dismantles the previous strict rule that "personal information may only be used for its explicitly stated purpose at the time of collection, and individual consent is mandatory for AI development."
For years, South Korea's AI sector has argued that the original legislation hindered technological advancement based on original personal data. Prior exemptions were narrowly scoped, covering only specific cases like voice anti-fraud systems and autonomous robots, with a validity period of two years, extendable to four.
The revised amendment will become effective six months after State Council approval. The committee intends to gather feedback from industry experts and stakeholders to draft detailed guidelines and subordinate regulations. Although the new rules relax constraints on local AI training, they introduce a "review and control" mechanism, ensuring that the boundaries of personal data usage remain regulated rather than self-determined by companies.
